Knowing When You Have Been Victimized by a Retaliatory Discharge or Other Action

Retaliation does not always result in termination. There are many things that an employer can do that can be classified as retaliation. In addition to being fired or demoted, you could be disciplined, receive a decrease in pay or benefits, get a negative evaluation, be transferred, or experience hostile behavior from your superiors.

Your Career and Reputation are at Stake Following a Retaliatory Discharge

At the Employee Rights Law Firm, we assess your case to identify if you have been the victim of retaliation. We investigate what specifically caused the employer's illegal actions that resulted in your unemployment, disciplinary action, or pay cut. Too much is at stake. Your ability to make a living. Your career. Your reputation.

There are laws that protect you against wrongful termination and reactionary behavior. To fight back, it is imperative that you secure the level of representation we can provide.

Why Might Your Employer Retaliate?

A situation qualifies as retaliation if it has an adverse effect on your employment and if you suspect it happened as a reaction to discrimination or sexual harassment complaints, wage and hour claims, use of Family and Medical Leave, or whistleblower actions.

Making claims of a "mean boss" is not legally protected activity such that you can necessarily assert a claim for retaliation. However, in many instances, employers do take severe retaliatory actions for the following:

  • Reporting a supervisor committing a crime
  • Taking an FMLA leave because of a pregnancy
  • Reporting an instance of age or race discrimination
  • Filing for workers’ compensation
  • Reporting sexual harassment

If you are unsure whether your employer is retaliating against you, an experienced workplace retaliation attorney can help you.

Gender Discrimination

Gender discrimination comes in many different forms, but generally it means that an employee or job applicant is treated differently (usually less favorably) because of their sex, sexual orientation, or gender identity. Gender discrimination can manifest in several different ways:

  • Getting a lower-paying position, or not getting hired at all, because of gender identity or sexual orientation
  • Being held to different or higher standards, disciplined, denied pay raises or advancement, or evaluated more harshly because of your gender identity or presentation
  • Being the subject of targeted behavior based on your gender, sexual identity, or sexual presentation - this includes unwelcome sexual advances, requests for sexual favors, verbal or physical harassment, being intentionally or repeatedly called by the wrong name or gender, insults, slurs, and more
  • Being rejected for a job, given fewer assignments, or forced out on leave because you're pregnant

Not all gender discrimination is explicit or intentional, and sometimes employees who report such discrimination receive retaliatory treatment as a result. Our team can help you determine whether the treatment you have received counts as gender discrimination or retaliation; we can then identify which steps you should take next.
